Terms of Service

1. Who you are contracting with

These Terms of Service ("Terms") form a binding agreement between you and Ahmed Ayman Ahmed Fouad Hamam ("we", "us", "our"), the operator of Goethi (the "Service"), accessible at goethi.online and goethi.lovable.app.

2. Acceptance

By accessing, browsing or purchasing access to the Service you agree to be bound by these Terms. If you do not agree, do not use the Service. If you are using the Service on behalf of an organisation, you confirm you have authority to bind it.

3. The Service

Goethi provides original German writing practice exams, model answers, vocabulary and learning materials for self-study. Some samples are free; additional samples are unlocked through one-time purchases.

4. Your account

You are responsible for keeping your account credentials confidential and for all activity under your account. You agree to provide accurate information and keep it up to date.

5. Acceptable use

You agree not to misuse the Service. In particular, you must not:

  • use the Service for any unlawful purpose, fraud, or spam;
  • infringe the intellectual property rights of us or any third party;
  • copy, redistribute, resell or republish our content (free or paid);
  • reverse engineer, scrape, or attempt to bypass technical or access limits;
  • upload malware or otherwise interfere with the security or integrity of the Service.

6. Intellectual property

All content on the Service — including practice exams, model answers, explanations, vocabulary lists, software, design and branding — is owned by us or our licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the content for your personal, non-commercial study, within the pack you have purchased.

7. Service level

We work hard to keep the Service available, but we do not guarantee uninterrupted or error-free performance. To the fullest extent permitted by law, the Service is provided "as is" and we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

8. Payments and Merchant of Record

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

Payment, billing, tax, cancellation and refund mechanics are governed by Paddle's Buyer Terms. Refunds are handled in line with our Refund Policy.

9. Suspension and termination

We may suspend or terminate your access to the Service if you materially breach these Terms, fail to pay, present a security or fraud risk, or repeatedly or seriously violate our policies. You may stop using the Service at any time.

10. Liability

To the fullest extent permitted by law, our aggregate liability arising out of or in connection with the Service is capped at the amounts you paid to us in the twelve months preceding the event giving rise to the claim. We exclude liability for indirect, consequential or special damages, including loss of profits, data or goodwill. Nothing in these Terms limits liability for fraud, death or personal injury caused by negligence, or any other liability that cannot be excluded by law.

11. Indemnity

You agree to indemnify us against any third-party claims arising from your unlawful use of the Service or your breach of these Terms.

12. Changes

We may update these Terms from time to time. Material changes will be communicated on this page; continued use of the Service after changes constitutes acceptance.

13. Governing law

These Terms are governed by the laws of the seller's place of residence, without regard to conflict-of-law rules. Disputes will be resolved in the competent courts of that jurisdiction, unless mandatory consumer law provides otherwise.
